Lightspeed Credit Card Surcharging Policy
LIGHTSPEED CREDIT CARD SURCHARGING POLICY

- Introduction
Where permitted by applicable laws, as a merchant, you may choose to offset your credit card processing fees by transferring a portion of the cost to your customer through a credit card surcharge. Credit card surcharges are an additional fee applied to any transaction paid with a credit card at the time of sale.
This Lightspeed Payments Surcharging Policy (the “Policy”) outlines the requirements that you, as a Lightpseed merchant, must respect when choosing to surcharge your customers.
- Scope and Application of the Policy
If you choose to charge your customers a credit card surcharge, there are a number of local laws and regulations that you must follow to ensure full transparency and compliance. Additionally, credit card surcharging must be done in compliance with the rules, regulations, policies, procedures, guidelines, and other requirements issued by Card Brands (i.e Visa, MasterCard, and American Express) (collectively, the “Card Brand Rules”).
Pursuant to your agreements with Lightspeed and this Policy, you are responsible for complying with all applicable laws, regulations, policies and guidelines issued by (i) your local regulators, and (ii) the Card Brands, and any amendments, changes, or modifications thereto. Lightspeed does not and will not provide you with any legal or regulatory advice regarding surcharging, nor will Lightspeed advise you on your decision to surcharge your customer.
Lightspeed may take action against your account if Lightspeed concludes, in its sole discretion, that you are in breach of this Policy, including without limitation (i) suspending your use of the Lightspeed services and products, and/or (ii) terminating your agreements with Lightspeed, effective immediately upon notice to you.
Lightspeed reserves the right, at any time, to modify or add to this Policy and to change, discontinue, and impose conditions on the surcharging functionality within the Lightspeed products without providing you with any written notice.
