Lightspeed and its group of companies (collectively, “Lightspeed”) have developed, created, used, and commercialized a variety of trademarks and copyrighted works, including names, logos, content, and other items protected under trademark and copyright law. These trademarks and copyrighted works are Lightspeed’s intellectual property and are among its most valuable assets. Lightspeed has developed these Trademark and Copyright Guidelines (“Guidelines”) to help third parties understand when they can use Lightspeed’s trademarks and copyrighted works and how to appropriately do so; proper use is important to protect Lightspeed’s intellectual property rights, strengthen its brand identity, and maintain the trust that people place in its products and services.
If you have a business relationship with Lightspeed (for example, if you are a Lightspeed referral or integration partner), you may have been granted a specific intellectual property license pertaining to your use of Lightspeed’s trademarks and/or copyrighted materials. These Guidelines are intended to supplement the license granted to you by Lightspeed, and govern how you use Lightspeed’s trademarks and copyrighted works.
It is important to Lightspeed that your use of its trademarks and copyrighted works adheres to these Guidelines and any applicable supplementary guidance. Lightspeed reserves the right, in its sole and absolute discretion and without notice, to revoke or modify the permissions granted in these Guidelines. Lightspeed disclaims any warranties that may be express or implied by law regarding Lightspeed’s intellectual property assets, including warranties against infringement.
Trademarks
Overview
Trademarks are used to identify and distinguish the source or origin of goods and services in a marketplace as between the trademark owner and third parties. They take a variety of forms, including words, phrases, symbols, designs, and colors. Lightspeed’s commercialization of its products and services in combination with its trademarks provides the public with the assurance that such products and services reflect Lightspeed’s high standards.
Lightspeed has applied for or received trademark registrations on several trademarks across the world. Below is a non-exhaustive list of Lightspeed’s trademarks, along with their preferred use and attribution designation:

Because this is a merely illustrative, non-exhaustive list of trademarks owned by Lightspeed, please note that the absence of a product or service name, logo, or otherwise from the above list does not constitute a waiver of Lightspeed’s trademark or other intellectual property rights. For convenience, all references to “trademarks” within these Guidelines include service marks as well.
Use Authorization
You may refer to Lightspeed’s trademarks in word form only to reference Lightspeed’s products and services, provided that such uses comply with these Guidelines. The only purposes for which you may use Lightspeed’s trademarks are limited to: (i) describing that your product or service is compatible with a Lightspeed product or service, or (ii) referring to a Lightspeed product or service in a written article.
In the absence of a trademark license granted to you by Lightspeed or equivalent authorization, you are not permitted to make use of Lightspeed’s trademarked logos. To the extent you have been granted such a license, your use of Lightspeed’s trademarked logos is subject to these Guidelines and any further supplemental guidance provided to you.
Except for the limited use rights permitted in these Guidelines, no other rights are granted to you. In all instances, the goodwill derived from use of Lightspeed’s trademarks inures to the benefit of Lightspeed.
General Use Guidelines
In addition to requirements elsewhere in these Guidelines and any supplemental guidance that may be provided to you, your use of Lightspeed’s trademarks must comply with the following:
Be truthful when using Lightspeed’s trademarks.
If you use a Lightspeed trademark to state that your product or service is compatible with that of Lightspeed, the product or service must in fact be compatible and otherwise interoperate or work with Lightspeed’s products and services as intended and as described in the documentation accompanying your product or service. Further, you may not use Lightspeed’s trademarks in a way that directly or indirectly implies Lightspeed’s sponsorship, affiliation, certification, endorsement, or approval in relation to you or your products and services. |
Trademarks are singular adjectives, and they should not be used as verbs or nouns, nor should they be made possessive.
Lightspeed’s trademarks are adjectives used to modify a noun that is the generic name of a product or service (e.g. “the Lightspeed ® commerce platform”). As adjectives, trademarks should not be made plural or possessive. When a trademark is used in a company name, rather than as a brand of products and services (e.g. when “Lightspeed” is used in Lightspeed Commerce Inc.), the entire company name can be possessive and does not need to be followed by the generic name of a product or service. |
Play nice when using Lightspeed’s trademarks.
Do not use Lightspeed’s trademarks in a disparaging, degrading, defamatory or libelous manner, or in connection with any obscene, pornographic, or illegal materials. |
Lightspeed’s trademarks should only be used to reference Lightspeed’s products and services.
Do not include the Lightspeed trademarks or anything confusingly similar in your company name, product or service name, domain name, or social media handle. Do not attempt to assert rights over the Lightspeed trademarks – e.g. by using or registering any Lightspeed trademark, or any alteration, variation, or extension of a Lightspeed trademark, as a part of the name for your company, product, or service. |
Display the Lightspeed trademarks in the way they are intended to be displayed.
Lightspeed’s trademarks may not be the most prominent visual element in your use – if applicable, your company name or logo, product or service name and brand should be significantly larger and more conspicuous than any Lightspeed trademark. Do not shorten, abbreviate, or modify any Lightspeed trademark, and always capitalize the Lightspeed trademark exactly as it appears within these Guidelines. Ensure proper notice and attribution is given. |
Don’t copy us.
You are not permitted to imitate Lightspeed’s trade dress. This includes the look and feel of Lightspeed’s brand, product imagery, websites, distinctive color combinations, or any typography, graphics, icons, or marketing imagery associated with Lightspeed’s products and services. |
Don’t use Lightspeed’s trademarks for paid advertising.
You cannot bid on or use a Lightspeed trademark, or any alteration, variation, or extension of a Lightspeed trademark, as a keyword on any search engine, or in any other form of paid advertising. |
Treat Lightspeed’s trademarks how you’d like your trademarks to be treated.
While these Guidelines may not explicitly address all permitted and prohibited uses of the Lightspeed trademarks, please be thoughtful in your use of the Lightspeed trademarks, and if you have any questions regarding their use, we’re happy to provide additional guidance.

Notice and Attribution
When using a Lightspeed trademark on your materials, you must use the appropriate trademark symbol typeset in superscript (™ or ®, as identified in the above trademark table) the first time the Lightspeed trademark appears in the text of the material. To the extent the materials are distributed outside of the United States, do not use the trademark symbols.
Regardless of the where the Lightspeed trademarks are used, they should always be coupled with an attribution statement in the following format appearing in small text at the end of the content bearing the trademark:

Copyrighted Works
Overview
Copyrights are exclusive rights in original works, such as written, pictoral and graphical works, audiovisual works and computer programs. The owner of a copyright in a work has the right to exclude others from reproducing, displaying, distributing, creating derivative works from, performing, or otherwise using the work. Lightspeed has copyrights in its logos, website design and content, videos, and its proprietary code (including object code and source code), among other things.
Use Authorization
You may not use, reproduce, distribute, or create derivative works from any copyrighted work owned by Lightspeed, or any portion thereof, without first receiving a license to do so, which shall outline specific rights granted to you with respect to your use of the copyrighted works. However, even after you have been granted a license to Lightspeed’s copyrighted works, Lightspeed retains the right to modify or revoke that permission in our sole discretion, unless prohibited in a separate agreement.
General Prohibitions
To ensure you are not infringing on Lightspeed’s copyrighted works, do not, without appropriate permission, engage in any of the following activities:
Do not copy, reproduce, distribute, reverse engineer, create derivative works of, or display any of Lightspeed’s copyrighted works or any part thereof. | Do not reproduce, modify, create, distribute, or display derivative works of any of Lightspeed’s copyrighted works or any part thereof. |
Do not imitate Lightspeed’s brand identity, including the visual appearance of Lightspeed’s copyrighted works. | Do not create works that appear to have originated from Lightspeed or appear to be endorsed by or affiliated with Lightspeed. |
Attribution
To the extent you have been granted license to use Lightspeed’s copyrighted works, your use should always be coupled with an attribution statement in the following format appearing in small text at the end of the content bearing the trademark:
